Warranty and Limited Remedy:

The SOLYX product will be free from defects in material and manufacture foa period of five (5) years from the date of installation. SOLYX Films SA Pty Ltd., MAKES NO WARRANTIES OCONDITIONS, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OFITNESS FOA PARTICULAPURPOSE OANY IMPLIED WARRANTY ARISING OUT OF A COURSE OF DEALING, CUSTOM, OUSAGE OF TRADE. Useis responsible fodetermining whethethe SOLYX product is fit foa particulapurpose and suitable fouser's method of application. If the SOLYX product is proven to be defective within the warranty period stated above, youexclusive remedy and SOLYX Films SA Pty Ltd., sole obligation shall be, at SOLYX Films SA Pty Ltd., option, to replace orepaithe SOLYX product orefund the purchase price of the SOLYX product. In no event shall SOLYX Films SA Pty Ltd., be liable fothe labooinstallation costs of replacing the SOLYX product except by arrangement with the installing SOLYX Dealer. SOLYX films can safely be applied to double insulated glass units with the exception of blackout films. SOLYX Films can be cleaned with a mild soapy watesolution and a soft cloth opapetowel. Limitation of Remedies And Liability: Except where prohibited by law, SOLYX Films SA Pty Ltd., will not be liable foany loss odamage arising from the SOLYX product, whethedirect, indirect, special, incidental, oconsequential, regardless of the legal theory asserted, including contract, warranty, negligence, ostrict liability.
